{"id":1899,"date":"2019-01-09T08:38:25","date_gmt":"2019-01-09T08:38:25","guid":{"rendered":"https:\/\/cita.co.uk\/news\/?p=1899"},"modified":"2019-01-09T08:38:25","modified_gmt":"2019-01-09T08:38:25","slug":"asbestos-blunder-costs-contractors-112000-in-court","status":"publish","type":"post","link":"https:\/\/cita.co.uk\/news\/asbestos-blunder-costs-contractors-112000-in-court\/","title":{"rendered":"Asbestos blunder costs contractors \u00a3112,000 in court"},"content":{"rendered":"<p>Two construction companies have been fined \u00a3112,000 after their subcontractors were exposed to asbestos fibres during school refurbishment work.<\/p>\n<p>Derby Crown Court heard that on 1 August 2016, Oakwood Junior school in Derby was undergoing refurbishment work during the school holidays.<\/p>\n<p>Two subcontractors removing suspended ceiling tiles entered a storage room which had a suspended ceiling made from asbestos containing ceiling tiles.<\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a data-ad-id=\"134243\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=++https%3A%2F%2Fwww.vpgroundforce.com%2Fgb%2Fshoring-equipment%2F%3Futm_source%3DGFS%2520CE%2520MPU%2520Advert%26utm_medium%3DWebsite%26utm_campaign%3DGFS%2520CE%2520MPU%2520Advert%26utm_term%3DGFS%2520CE%2520MPU%2520Advert%26utm_content%3DShoring%2520Equipment%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"http:\/\/www.constructionenquirer.com\/wp-content\/uploads\/grounforce37640-GF Shorco 300x250px CE Ad B.gif\"\/><\/a><\/div>\n<\/div>\n<p>They started to remove the tiles, unaware that they contained asbestos, potentially exposing themselves to harmful fibres.<\/p>\n<p>A licensed asbestos removal company working on site alerted management to the situation and action was taken to stop the work and deal with the contamination.<\/p>\n<p>An HSE investigation found that main contractor Ashe Construction Limited failed to effectively plan, manage and monitor the work to prevent the accidental removal of the asbestos containing tiles.<\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a data-ad-id=\"260696\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fwww.doka.com%2Fuk%2Fsystem-groups%2Fdoka-safety-systems%2Fprotection-screens%2Fxclimb-60%2Findex%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"http:\/\/www.constructionenquirer.com\/wp-content\/uploads\/DOKA-3a.gif\"\/><\/a><\/div>\n<\/div>\n<p>Ashe also failed to effectively communicate information about the asbestos, leaving the storage room open without barriers or signage warning of asbestos.<\/p>\n<p>The work was not then suitably managed or monitored to ensure that nobody came into contact with the asbestos.<\/p>\n<p>The HSE also found that Cladceil Limited, a contractor appointed by Ashe to carry out the suspended ceiling removal work, also failed to effectively plan, manage and monitor the work.<\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a data-ad-id=\"94603\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fen-gb.viewpoint.com%2F%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"http:\/\/www.constructionenquirer.com\/wp-content\/uploads\/Viewpoint-Ban-300x250.gif\"\/><\/a><\/div>\n<\/div>\n<p>The company appointed a subcontractor to remove the suspended ceilings on its behalf but provided only a generic risk assessment and method statement which failed to identify important information, including the asbestos risk.<\/p>\n<p>Ashe Construction of Hitchin, Herefordshire pleaded guilty to breaching CDM and safety regulations and was fined \u00a3100,000 and ordered to pay costs of \u00a39,759.76.<\/p>\n<p>Cladceil Limited of\u00a0 Nottingham pleaded guilty to breaching CDM regulations and was fined \u00a312,000 and ordered to pay costs of \u00a347,184.48.<\/p>\n<p>Speaking after the hearing, HSE inspector Andrew Bowker said: \u201cThe exposure to asbestos could so easily have been avoided if the two companies involved had put sufficient effort into planning, managing and monitoring the ceiling tile removal work.<\/p>\n<p>&#8220;HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards.\u201d<\/p>\n<p>from Construction Enquirer http:\/\/bit.ly\/2FkHVZQ<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Two construction companies have been fined \u00a3112,000 after their subcontractors were exposed to asbestos fibres during school refurbishment work.
