{"id":6514,"date":"2025-07-10T07:46:52","date_gmt":"2025-07-10T07:46:52","guid":{"rendered":"https:\/\/cita.co.uk\/news\/?p=6514"},"modified":"2025-07-10T07:46:52","modified_gmt":"2025-07-10T07:46:52","slug":"henry-family-and-directors-face-claims-topping-31m","status":"publish","type":"post","link":"https:\/\/cita.co.uk\/news\/henry-family-and-directors-face-claims-topping-31m\/","title":{"rendered":"Henry family and directors face claims topping \u00a331m"},"content":{"rendered":"<p>Administrators of collapsed contractor Henry Construction Projects have launched claims totalling over \u00a331m against its former directors and members of the Henry family.<\/p>\n<p>FRP Advisory set out the extent of the multiple claims it is pursuing in the latest administrators&#8217; update for trade creditors.<\/p>\n<p>This follows extensive investigations into payments made in the run-up to the firm\u2019s administration last summer.<\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a data-ad-id=\"494661\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fbrand-accesssolutions.com%2F%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"https:\/\/www.constructionenquirer.com\/wp-content\/uploads\/brand slower ezgif.com-animated-gif-maker.gif\"\/><\/a><\/div>\n<\/div>\n<p>A \u00a310m dividend paid in January 2023 by Henry Construction to its parent Holding company \u2013 while the parent still owed a similar amount back \u2013 is at the centre of one major claim.<\/p>\n<p>That money later ended up in the hands of Elizabeth Henry, the mother of former Henry Construction boss Mark Henry, just days before the company went under, says FRP.<\/p>\n<p>FRP has issued proceedings against Mark Henry and former director John Noone for breach of fiduciary duty, as well as Elizabeth Henry as the final recipient of the cash.<\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a data-ad-id=\"491998\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fciob.me%2FCIOBvalue%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"https:\/\/www.constructionenquirer.com\/wp-content\/uploads\/Value_MPU.gif\"\/><\/a><\/div>\n<\/div>\n<p>It is are now seeking repayment of the full \u00a310m plus interest.<\/p>\n<p>A further \u00a315.8m is being chased from a network of linked firms dubbed the \u201cKeash Companies\u201d, several of which list Mark Henry, his wife Therese Woulfe, and his brother Liam as directors or former directors.<\/p>\n<p>FRP alleges the companies benefitted from unpaid debts. The heads of claim include debt claims, unjust enrichment, and unconscionable receipt.<\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a data-ad-id=\"479429\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fwww.vpgroundforce.com%2Fgb%2Fyoursolution%2F%3Futm_source%3Dconstructionenquirersite%26utm_medium%3Dwebskins%26utm_campaign%3Dys%252Blaunch%26utm_id%3Dyoursolution%252Blaunch%26utm_content%3DMPU%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"https:\/\/www.constructionenquirer.com\/wp-content\/uploads\/groundforceCE MPU 300 x 250.gif\"\/><\/a><\/div>\n<\/div>\n<p>A separate \u00a35.5m claim was filed in April this year over what the administrators allege are personal benefits extracted from the business by members of the Henry family. These include:<\/p>\n<ul>\n<li data-start=\"1840\" data-end=\"1921\">\n<p data-start=\"1842\" data-end=\"1921\">\u00a32m paid to HMRC to settle personal tax bills for Elizabeth and William Henry (Mark Henry&#8217;s now deceased father)<\/p>\n<\/li>\n<li data-start=\"1922\" data-end=\"2031\">\n<p data-start=\"1924\" data-end=\"2031\">Free construction works at properties owned by Mark Henry, Therese Woulfe, and Mark\u2019s sister Sarah Dundon<\/p>\n<\/li>\n<li data-start=\"2032\" data-end=\"2122\">\n<p data-start=\"2034\" data-end=\"2122\">\u00a3132k paid to Woulfe shortly before the collapse, allegedly for mental health training provided to the company<\/p>\n<\/li>\n<li data-start=\"2123\" data-end=\"2167\">\n<p data-start=\"2125\" data-end=\"2167\">A \u00a3270k director\u2019s loan owed by Mark Henry<\/p>\n<\/li>\n<\/ul>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a data-ad-id=\"478038\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fwww.creaghconcrete.co.uk%2F%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"https:\/\/www.constructionenquirer.com\/wp-content\/uploads\/CE_Creagh.gif\"\/><\/a><\/div>\n<\/div>\n<p>The action names Mark Henry, John Noone, Elizabeth Henry, Sarah Dundon, Sean Dundon, and Therese Woulfe as defendants.<\/p>\n<p>Administrators have confirmed that none of the parties responded to letters before action, prompting formal claims earlier this year.
